License terms for the download and use of the native macOS software LazyLips. Please read these carefully before purchasing.
These General Terms and Conditions (GTC) together with the End User License Agreement (EULA) apply to all contracts regarding the digital download and use of the macOS software "LazyLips" (hereinafter "Software" or "Service").
The contractual partner of the user (hereinafter "User", "Consumer" or "Customer") is:

All purchases and billing are legally processed via our Authorized Reseller ("Merchant of Record") LemonSqueezy, which is why their purchase conditions (Checkout Terms) primarily apply.
The software is not sold, but licensed as part of a subscription ("rental").
Upon successful registration and payment, the user is granted a simple, non-exclusive, worldwide right, limited in time to the duration of the subscription, to install and use the software as executable object code (macOS Binary) on their personal devices in accordance with the contract.
Usage restrictions: It is strictly forbidden to decompile, reverse engineer, extract the source code, resell, automatically attack (e.g. API raping) or bypass the copy protection mechanisms of the software.
Free Trial Phase: The software may (if offered) be used free of charge on a trial basis for 14 days ("Trial Limit"). After that, access to premium features expires.
Running Subscriptions (Flex / Pro): The subscription begins immediately on the day of payment. It automatically renews for the selected contract term (e.g. 1 month for the Flex tariff, 12 months for the Pro tariff) unless it is cancelled online in due time before the renewal date via the customer dashboard or the LemonSqueezy link in the purchase confirmation email.
As a consumer within the meaning of § 13 BGB (German Civil Code), you are legally entitled to a 14-day right of withdrawal for distance selling contracts.
Premature expiration of the right of withdrawal for digital content (Software Downloads):
Please note that the LazyLips App is digital content that is not supplied on a physical data carrier (such as a CD). According to **§ 356 Paragraph 5 BGB**, your statutory right of withdrawal for such a purchase contract expires **prematurely** if we have begun to execute the contract (provision of the download link or license key) AFTER you have expressly agreed that we begin to execute the contract before the expiration of the withdrawal period, and you have confirmed your knowledge that by giving your consent with the start of the execution of the contract you lose your right of withdrawal.
Practical note: You actively agree to this legal expiration condition at checkout via a non-pre-selected mandatory checkbox ("I agree to immediate execution and lose my right of withdrawal") in order to receive the license key immediately. Otherwise, we would legally have to withhold the key from you for 14 days.
The software and backend rely on essential services from third-party providers (specifically Cloudflare for network infrastructure, Supabase for databases, and LemonSqueezy for licensing). The provider is not liable for server downtimes, API changes, or data loss caused by these third-party providers.
Furthermore, the provider assumes no liability or legal warranty to the user, to the extent permitted by law, for the 100% accuracy of the texts generated, transcribed or formatted by the AI. Large Language Models (LLMs) are subject to technological peculiarities (so-called AI hallucinations) which can cause errors.
It is the sole responsibility of the user to completely verify every text transcribed by LazyLips manually for correctness and completeness before sending or saving it.
Otherwise, the provider is only liable without limitation for intent and gross negligence. In the event of slight negligence, the provider is only liable for a breach of essential contractual obligations (cardinal obligations).
The provider will provide security and functionality-related software updates (patches) for the duration of your active, paid subscription. However, there is no contractual right to the development of fundamentally new features ("further development").
